Article 1: Provider’s Obligations
BROTHERS Event Management Sàrl commits to providing the services specified in the price offer, which must be signed and approved by the client to take effect.
Article 2: Intellectual Property
Any original content created by BROTHERS or its subcontractors for the event, including but not limited to designs, music, routines, and scripts, remains the property of BROTHERS Event Management Sàrl. The client obtains a limited license to use these materials solely within the context of the scheduled event, unless otherwise stated in writing.
Article 3: Payment Terms
Payment for the agreed services will be staggered as follows: a deposit of 50% is required to confirm the booking. The reservation will be considered final once the deposit has been received. The remaining balance will be invoiced and payable after the event.
Article 4: Force Majeure
In the event of force majeure such as natural disasters, strikes, civil disputes, significant transportation disruptions, pandemics, or any other circumstance beyond the reasonable control of the parties preventing the execution of the contract, the obligations of the parties will be suspended. The parties will endeavour to find a solution to reschedule the event or adjust the services to the new situation. Any payments already made for services not rendered due to force majeure may be refunded or credited for a future event, according to terms to be agreed upon.
Article 5: Subcontracted Catering Service
The catering service is provided via subcontracted partners selected by BROTHERS Event Management Sàrl. The final number of participants must be confirmed 7 days before the event. Brothers Events cannot guarantee service for unconfirmed guests, and the final invoice will be adjusted based on the confirmed number of participants. In case of guest cancellations after this deadline, the client will be billed based on the initially planned number of guests. BROTHERS Event Management Sàrl will act as an intermediary between the client and the catering partners, but will not be responsible for the actions or failures of these partners, except in terms of coordination and clearly specified communication obligations in the contract.
Article 6: Responsibility for Rented Equipment
Since rented equipment is not insured, the renter assumes full responsibility for it during the rental period. Any damage, loss, or breakage will be billed to the renter. It is prohibited to use grills under the rented pavilions or tents.
Article 7: Insurance for Events
For all events, especially team-building types, it is required that each participant be covered by personal liability insurance. This insurance must cover any damage or injury caused to third parties or property during the event. Furthermore, BROTHERS Event Management Sàrl may offer or prescribe the option to subscribe to special insurance tailored to the needs of the event.
Article 8: Rescheduling Policy
– Any request to reschedule the event must be made at least 7 days prior to the scheduled event date, without incurring additional fees.
– Rescheduling requests made within 7 days of the event will incur a fee of 50% of the total project cost.
Article 9: Client Cancellation Terms
In the event of cancellation by the client within 30 days prior to the event, cancellation fees will be applied as follows:
– From 29 to 15 days before the event: 50% of the total amount.
– From 14 to 8 days before the event: 70% of the total amount.
– From 7 to 1 day before the event: 80% of the total amount.
– On the day of the event: 100% of the total amount.
Article 10: Competent Jurisdiction
In case of a dispute, the parties agree that only the courts of Luxembourg will have jurisdiction.
Article 11: Acceptance of Terms
The parties declare that they have read and understood these general conditions and accept them without reservation.
